I don't suppose I need to say this, but it seems reasonable that his fear may be based on the very real possibility of the right(sic) taking control of congress after the mid-terms.

Then having the Sucker-Punch Court composed of 9 conservatives, 3 human beings. (Or whatever number of total judges it turns out to be.)

Seriously, am I missing something? This fear seems legit, but I've not heard it expressed, so I presume I'm missing some important point.
