Why do I get a sick feeling that this is nothing more than a "doomed to failure" strategy to find yet another reason to set up public education up for attack? (And not the good kind?)

It's pretty clear the right wants nothing more than to replace public education with taxpayer-supported charter school Christian education, and now with the full support of the Supreme(sic) Court.
